This week, Indiana's popular Right to Work law officially took effect -- and the much-needed legislation is already paying off.
"
I probably underestimated how important an addition to our already excellent business climate (Right to Work) was going to be," Indiana Governor Mitch Daniels told the press this week after identifying 31 companies considering creating jobs in the Hoosier State now that it protects worker freedom.
International Union of Operating Engineers Local 150 union lawyers recently withdrew their request for a temporary restraining order to prevent the law from taking effect...
... after National Right to Work Foundation attorneys filed an
amicus brief for a group of independent-minded workers in support of the law.
But Big Labor is still going ahead with the desperate legal assault to dismantle the law in the courts.
The union bosses hope that by dragging out the battle in Indiana, they will also suppress the growing Right to Work movements in other states like New Hampshire and Montana.
Fortunately, Foundation attorneys have successfully defended state Right to Work laws in the past, most recently in Oklahoma, and are confident of prevailing again.
Incredibly, union lawyers contend that Indiana's Right to Work law is "preempted" by the National Labor Relations Act -- even though federal labor law specifically affirms the right of states to enact Right to Work laws.
Moreover, in the Foundation-won
Davenport v. Washington Education Association (2007), the United States Supreme Court reiterated that, as the Court had originally decided in 1949, Right to Work laws are constitutional.
Union bosses know that for decades the courts have upheld Right to Work laws while acknowledging the fundamental conflict between compulsory unionism and freedom of association.
But as the Obama Administration's appointments add up in the federal judiciary, they hope this may change in the years it could take for this suit to hit the U.S. Supreme Court.
That's why it's vital we continue to aggressively defend Indiana's Right to Work law every step of the way.
