Dear Jack,

The legal briefs were filed. The plane tickets were purchased. The bags were packed.

On Friday, just hours after National Right to Work Foundation-assisted Indiana workers filed an amicus brief to defend the state's popular new Right to Work law from a groundless Big Labor legal assault...

...and with Foundation staff attorney Milton Chappell set to appear in federal court in Indiana today, the union lawyers abruptly abandoned their motion for a temporary injunction to keep the Right to Work law from taking effect on March 12.

The forces of freedom won this first test, but Big Labor's attack rages on -- an attack aimed not just at Indiana's newly-enacted Right to Work law but all 23 Right to Work states.

Not only that, the Big Labor hierarchy hopes that by dragging out the battle in Indiana, they will also suppress the growing Right to Work movements in other states like New Hampshire and Montana.

It started last year when Big Labor-backed legislators tried to stall the debate by fleeing to Illinois.

Then, when the Right to Work law was introduced again in the Indiana legislature in 2012, union bosses packed the capitol with angry protestors hurling insults at those who support worker freedom.

After forced-unionism partisans failed to win the hearts and minds of Indiana's workers and voters and Indiana became the 23rd Right to Work state, union militants threatened to disrupt the Super Bowl in Indianapolis.

Now, they want to dismantle the law in the courts.

Each step of the way, Big Labor's tactics have been designed with two goals.

They have failed, so far, at their first goal -- killing Right to Work in Indiana.

But no matter the outcome in Indiana, they want to frighten grassroots activists and pro-worker freedom legislators nationwide by showing them how far they'll go to protect their forced-dues power.

Fortunately, Foundation attorneys have successfully defended state Right to Work laws in the past, most recently in Oklahoma, and are confident of prevailing again.

Incredibly, union lawyers contend that Indiana's Right to Work law is "preempted" by the National Labor Relations Act -- even though federal labor law specifically affirms the right of states to enact Right to Work laws.

Moreover, in the Foundation-won Davenport v. Washington Education Association (2007), the United States Supreme Court reiterated that, as the Court had originally decided in 1949, Right to Work laws are constitutional.

Union bosses know that for decades the courts have upheld Right to Work laws while acknowledging the fundamental conflict between compulsory unionism and freedom of association.

But as the Obama Administration's appointments add up in the federal judiciary, they hope this may change in the years it could take for this suit to hit the U.S. Supreme Court.

That's why it's vital we continue to aggressively defend Indiana's Right to Work law every step of the way.
